Virginia employer convicted of employing illegal aliens

ALEXANDRIA, Va. - Felisberto Magalhaes, 55 of Manassas, Va., pled guilty today to a pattern or practice of illegal employment of aliens without lawful authority to work in the United States. Chuck Rosenberg, United States Attorney for the Eastern District of Virginia, and Mark X. McGraw, Acting Special Agent in Charge, U.S. Immigration and Customs Enforcement (ICE) Washington, D.C. office made the announcement after the guilty plea was accepted by United States Magistrate Judge John F. Anderson. Magalhaes was also sentenced today to one year probation, and was ordered to pay $122,000 in forfeiture.

According to documents filed in court, Magalhaes was associated with CMC Concrete and Stonewall Concrete, both based in Manassas, Va. Magalhaes hired aliens without lawful permission to work or reside in the United States. During the execution of a search warrant on March 24, 2008, special agents with ICE encountered 34 aliens without lawful permission to work or reside in the United States. Approximately 257 aliens employed were using Social Security numbers that had not been issued to anyone or had been issued to people other than the aliens using the numbers.

This case was investigated by the ICE, with assistance from the U.S. Department of Labor. Assistant United States Attorney Beth Gibson prosecuted the case on behalf of the United States.
